Terms and Conditions

1. Eligibility

• You must be at least 18 years old to participate in contests and receive prizes.
• Users between 13 and 17 may create an account but are not eligible for cash prizes without verified parental or guardian consent.
• Users under 13 are not permitted to register. Registration by a person under 13 violates our Terms and, for US-based users, the Children's Online Privacy Protection Act (COPPA).
• By registering, you confirm that the information you provide is accurate and complete.

2. Account Registration

• You are responsible for maintaining the confidentiality of your account credentials.
• You may not share your account or allow others to use it on your behalf.
• You must notify us immediately at AvelirCS@outlook.com if you suspect unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Submitted Content

• All music submitted to Avelir must be generated using artificial intelligence tools. Submissions of entirely human-performed recordings are not permitted in AI-specific contest categories.
• By submitting content, you confirm that you have the right to submit it and that it does not infringe any third-party intellectual property rights, including copyrights, trademarks, or rights of publicity.
• You retain ownership of your submitted works. However, by submitting, you grant Avelir a non-exclusive, worldwide, royalty-free licence to display, stream, and promote your submission within the platform for contest and marketing purposes.
• You may not submit content that is defamatory, obscene, hateful, or otherwise unlawful.
• We reserve the right to remove any submission at our discretion without prior notice.

4. Audio Content and Third-Party Platforms

• Avelir does not host audio files. All audio is streamed via embedded players from third-party platforms (such as Suno, Udio, SoundCloud, or similar). Avelir stores only the URL or embed link provided by the user.
• Copyright claims regarding the audio content of a track must be directed to the originating platform where the audio is hosted, not to Avelir.
• Avelir is not responsible for the availability, accuracy, or content of third-party platforms. If a third-party platform removes or restricts a track, that track may become unavailable on Avelir without notice.
• The copyright status of AI-generated music is an evolving legal area. By submitting a track, you represent that you have reviewed and comply with the terms of service of the AI platform you used to generate the music.

DMCA / Copyright Takedown: If you believe that content displayed on Avelir infringes your copyright, please send a written notice to AvelirCS@outlook.com with the subject "DMCA Takedown Request" including: (1) identification of the copyrighted work claimed to be infringed; (2) identification of the material on Avelir you believe infringes your work; (3) your contact information; (4) a statement that you have a good faith belief the use is not authorised; (5) a statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorised to act on their behalf. We will respond within 14 business days.

5. Contest Rules

• Free participation: Entry into Avelir contests is free of charge. No purchase is necessary to enter or win. Requiring a paid consideration would render a promotion an illegal lottery under applicable EU and US law.
• Each eligible user may submit one (1) track per monthly contest period.
• Winners are determined by community vote count at the close of each monthly contest period. This is a skill/merit-based contest, not a game of chance.
• Avelir administrators reserve the right to disqualify entries for rule violations, including vote manipulation.
• Vote manipulation (bots, sock puppet accounts, coordinated inorganic voting) is strictly prohibited and will result in permanent account suspension.
• Prize amounts are displayed on the platform and subject to change before a new contest month begins; amounts are fixed once a contest period opens.
• Winners will be contacted via their registered email address within 14 days of contest close.
• Prizes are subject to applicable taxes in the winner's jurisdiction. Avelir is not responsible for any tax obligations arising from prizes received. US winners receiving prizes over $600 in a calendar year may receive a Form 1099 as required by IRS regulations.
• US participants — FTC disclosure: All contest rules, entry methods, prize details, and odds of winning are disclosed on the platform. No material connection exists between Avelir and contest entrants beyond the contest itself.
• US participants — state law: Void where prohibited by law. Residents of New York, Florida, and Rhode Island should note that cash prize contests valued over $5,000 may be subject to additional state registration and bonding requirements. We will comply with applicable state law for each contest period.
• EU participants: Contest participation is free as required under EU promotional contest regulations. No element of chance determines the winner — community vote count is the sole criterion.

6. Electronic Communications

• By creating an account, you consent to receive transactional emails from Avelir, including account verification, password reset, and prize notifications. These are not marketing emails.
• We do not send unsolicited commercial email (spam). All emails include our name, a valid return address, and, where applicable, an opt-out mechanism, in compliance with the US CAN-SPAM Act (15 U.S.C. § 7701) and EU ePrivacy Directive.
• To opt out of non-essential communications, email AvelirCS@outlook.com with "Unsubscribe" in the subject line. Transactional emails necessary for account operation cannot be opted out of while your account is active.

7. Prohibited Conduct

You agree not to:

• Use automated tools, bots, or scripts to cast votes or interact with the platform.
• Create multiple accounts for the purpose of gaining an unfair advantage.
• Attempt to access, probe, or test the security of the platform without authorisation.
• Reverse-engineer, decompile, or otherwise attempt to derive the source code of the platform.
• Interfere with or disrupt the integrity or performance of the Service.
• Upload or submit content containing malware, viruses, or any other malicious code.
• Use the Service for any unlawful purpose or in violation of applicable laws.

8. Account Suspension and Bans

• We reserve the right to suspend or permanently ban any account that violates these Terms, without prior notice.
• Banned users may not create new accounts. Circumventing a ban is itself a violation of these Terms.

9. Intellectual Property

• The Avelir name, logo, design, and all platform code are the exclusive property of Avelir and are protected by applicable intellectual property laws.
• Nothing in these Terms grants you any right to use Avelir's trademarks, logos, or branding without prior written consent.
• User-submitted content remains the property of the submitting user, subject to the licence granted in Section 3.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for the actions, content, or availability of third-party platforms from which audio is embedded.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Avelir shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability to you shall not exceed the total amount of prizes actually paid to you in the six (6) months preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

12. Modifications to the Service and Terms

• We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email or by a prominent notice on the platform at least 14 days before changes take effect.
• Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
• We may modify, suspend, or discontinue the Service (or any part thereof) at any time without liability.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Romania and, where applicable, the laws of the European Union.

EU/Romanian users: You have the right to bring a dispute before the competent courts of Romania or to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

US users: Any disputes shall be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA), conducted in English. You waive the right to participate in any class action lawsuit or class-wide arbitration. This arbitration clause does not apply to claims that qualify for small claims court.
